1. Scope of Services

David Towing PA provides 24/7 towing, vehicle recovery, winching, and emergency roadside assistance (including jump-starts, lockouts, tire changes, and fuel delivery) across Pennsylvania.

• Dispatch & Availability: Service availability, response times, and equipment dispatch are subject to traffic conditions, weather events, equipment availability, and road safety regulations.
• Estimated Times of Arrival (ETAs): All ETAs provided by phone, SMS, or online forms are good-faith estimates and are not legally binding guarantees.

2. Service Requests, Authorization & Vehicle Ownership

When requesting roadside or towing service:

• Authorization: You represent and warrant that you are the lawful owner of the vehicle, an authorized operator, or an authorized agent (e.g., insurance representative, fleet manager) with legal authority to order vehicle recovery, transport, or entry.
• Accuracy of Information: You must provide accurate vehicle location details, make/model, condition (e.g., all-wheel drive, missing keys, frame damage, locked steering), and destination. Providing inaccurate information may result in additional fees or service delays if different equipment is required.
• Presence at Scene: Unless explicitly agreed upon with dispatch, the vehicle owner or authorized driver must be present with valid photo identification and proof of vehicle ownership/authorization upon the tow operator’s arrival.

3. Pricing, Rates & Payment Terms

• Rates & Quotes: Quotes provided over the phone or online are estimates based on initial information. Final pricing may vary based on unforeseen roadside conditions, extended winching times, dollies/specialized equipment requirements, after-hours storage, toll charges, or changes in drop-off location.
• Payment Due Date: Payment is due in full immediately upon completion of the roadside service or delivery of the vehicle to the designated location, unless direct-billing arrangements have been formally established with an approved insurance carrier or commercial account.
• Accepted Payment Methods: Major credit/debit cards, electronic payments, or cash as specified by dispatch.
• Cancellation Policy: If you cancel a requested service after a driver or tow truck has already been dispatched to your location, you may be assessed a standard Dispatch / Gone-on-Arrival (GOA) Fee to cover travel and operator time.

4. SMS & Mobile Communications (A2P 10DLC Compliance)

By providing your phone number to David Towing PA, you expressly consent to receive service-related communications, including automated transactional text messages (SMS) and phone calls from (610) 671-4323:

• Message Purpose: Messages include dispatch alerts, real-time driver ETA updates, location confirmations, and digital receipts.
• Message Frequency: Message frequency varies per service incident.
• Opt-Out & Help: You can cancel SMS notifications at any time by replying STOP to any text message. Reply HELP for customer support or call our dispatch desk at (610) 671-4323.
• Rates: Standard message and data rates may apply according to your wireless carrier plan.
• No Third-Party Sharing: Mobile opt-in data and phone numbers are strictly used for service fulfillment and are never shared, rented, or sold to third parties for marketing purposes.

5. Limitation of Liability & Vehicle Condition

• Pre-Existing Damage: David Towing PA is not liable for pre-existing mechanical failure, body damage, paint oxidation, frame fatigue, or electrical issues existing prior to our arrival.
• Emergency Entry & Roadside Risks: Lockout services, jump-starts, and winching operations inherently carry minor risks (such as weather stripping wear, battery terminal fatigue, or undercarriage contact on non-paved terrain). Our operators use industry-standard care, but we are not liable for incidental damage resulting from non-standard vehicle modifications or severe terrain conditions.
• Personal Belongings: Customers are responsible for removing all valuables and personal property from the vehicle prior to tow transport or storage. David Towing PA assumes no liability for lost or stolen personal items left inside unattended vehicles.

6. Storage & Impound Regulations

Vehicles towed to our secure holding yard or storage facility are subject to standard daily storage rates and statutory lien laws under Pennsylvania vehicle codes. Vehicles not claimed or released within the timeframe established by Pennsylvania law may be subject to legal impound disposal or lien auctions.

7. Intellectual Property & Website Use

All content on www.davidtowingpa.com, including text, logos, graphics, and vCard assets, is the property of David Towing PA and protected by intellectual property laws. You agree not to misuse, scrape, or reverse-engineer any portion of the site.

8. Governing Law & Dispute Resolution

These Terms and any disputes arising from our services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any legal proceedings shall be filed in the state or federal courts situated in Pennsylvania.
